Terms of Service

Welcome to NOKK. These Terms of Service ("Terms") govern your access to and use of the NOKK financial management platform and related services (collectively, the "Service") provided by Appsways Inc. ("NOKK," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use the Service. By using NOKK, you represent that you are at least 18 and have the legal capacity to enter into binding contracts.

2. Account Registration

You must create an account to use the Service. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials
• Notify us immediately at hello@nokk.homes if you suspect unauthorized access
• Accept responsibility for all activity that occurs under your account

3. Subscription Plans and Billing

3.1 Free Plan

The Free plan is available at no charge and includes limited features: one property, basic tracking, and dashboard access. No credit card is required.

3.2 Starter Plan

The Starter plan is $9.00 USD per month. Includes up to 4 units and unit-level transaction ledger.

3.3 PRO Plan

The PRO plan is $19.00 USD per month. Includes unlimited properties, PDF exports, tax-ready reports, profitability by door, property manager tracking, and priority support.

3.4 Billing

Payments are processed by Stripe. By subscribing, you authorize NOKK to charge the payment method on file on a recurring monthly basis until you cancel. All charges are non-refundable except as described in Section 3.6.

3.5 Cancellation

You may cancel your subscription at any time via the billing portal in your account settings. Cancellation takes effect at the end of the current billing period.

3.6 Refunds

We offer a 7-day money-back guarantee for your first subscription payment. To request a refund within this window, email billing@nokk.homes.

3.7 Price Changes

We reserve the right to change subscription pricing with at least 30 days advance notice via email.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

• Use the Service to manage illegal properties or facilitate illegal activities
• Attempt to gain unauthorized access to another user's account or data
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts, bots, or crawlers to access the Service
• Transmit malware, viruses, or any harmful code
• Overload the Service or circumvent rate limits
• Resell or sublicense access without written permission

5. Your Content and Data

You retain ownership of all financial data, property records, and other content you enter into the Service ("Your Content"). By using the Service, you grant NOKK a limited, non-exclusive license to store, process, and transmit Your Content solely for the purpose of providing the Service.

You are responsible for the accuracy of your data. NOKK is a financial tracking tool — it is not a licensed accounting, legal, or tax advice service.

6. Tax Reports Disclaimer

NOKK provides tools to help organize your rental income and expenses. Reports are provided as a convenience to assist you in working with your tax professional. They do not constitute tax advice. Always have a licensed CPA review your tax returns.

7. Intellectual Property

The Service, including its software, design, trademarks, and content, is owned by NOKK and protected by copyright, trademark, and other intellectual property laws.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy, which is incorporated into these Terms by reference.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

10. Termination

You may close your account at any time by contacting hello@nokk.homes. We may suspend or terminate your account if you breach these Terms. Your data will be retained for 30 days after termination to allow export.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOKK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD.

13. Indemnification

You agree to indemnify and hold harmless NOKK and its officers, directors, employees, and agents from any claims arising from your use of the Service or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law provisions. Any disputes will be resolved in the courts of Montreal, Quebec.

15. Changes to Terms

We may update these Terms from time to time. We will provide at least 14 days' notice of material changes. Continued use of the Service after the effective date constitutes acceptance.
